By accessing or using Classroom Pulse ("Service," "Platform," or "Application"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a school, district, or educational organization, you represent that you have the authority to bind that entity to these Terms. These Terms constitute a legally binding agreement between you (and your organization) and Classroom Pulse. If you do not agree to these Terms, you may not access or use the Service.

Classroom Pulse provides a comprehensive behavior tracking and analysis platform for educational professionals. Our Service includes: • Behavior frequency, duration, and intensity tracking tools • Functional Behavior Assessment (FBA) data collection • Behavior Intervention Plan (BIP) monitoring and support • Progress monitoring and reporting for IEP goals • AI-powered insights and analytics • Secure parent communication and report sharing • Team collaboration features for educational staff • Professional development resources

Eligibility Requirements: • You must be 18 years or older to create an account • You must be an authorized educational professional or parent/guardian • Student accounts are not permitted (educators manage student data) • You must provide accurate, current, and complete information Account Security: • You are responsible for maintaining the confidentiality of your login credentials • You must immediately notify us of any unauthorized access or security breach • You are liable for all activities that occur under your account • Sharing accounts or credentials is strictly prohibited

Permitted Uses: You may use Classroom Pulse to: • Track and analyze student behavioral data for educational purposes • Support IEP/504 plan development and monitoring • Generate reports for educational decision-making • Communicate with parents about student progress • Collaborate with educational team members Prohibited Uses: You may NOT: • Use the Service for any illegal or unauthorized purpose • Violate any local, state, national, or international law • Transmit malware, viruses, or malicious code • Attempt to gain unauthorized access to any part of the Service • Use the Service to harass, abuse, or harm others • Create multiple accounts for fraudulent purposes • Share or sell access to your account

We take student privacy seriously and comply with all applicable laws including: • Family Educational Rights and Privacy Act (FERPA) • Children's Online Privacy Protection Act (COPPA) • State student privacy laws Data Ownership: • Educational institutions retain ownership of all student data • We act as a service provider under FERPA • We do not sell, rent, or share student data with third parties • Data is used solely to provide and improve the Service Data Security: • We implement industry-standard security measures • All data is encrypted in transit and at rest • Regular security audits and assessments are conducted • Incident response procedures are in place

Subscription Plans: • Free Plan: Limited features for individual educators • Essential Plan: Full features for individual educators • Professional Plan: Team collaboration and advanced features • School/District Plans: Custom pricing for institutions Billing: • Subscriptions are billed monthly or annually • Payment is due upon subscription renewal • All fees are in US dollars unless otherwise specified • Taxes may apply based on your location Refunds: • We offer a 14-day money-back guarantee for new subscriptions • Refunds are not provided for partial billing periods • Educational institutions may have custom refund terms

Service Content: • All Service content, features, and functionality are owned by Classroom Pulse • This includes but is not limited to text, graphics, logos, and software • The Service is protected by copyright, trademark, and other laws User Content: • You retain ownership of content you create using the Service • You grant us a license to use your content to provide the Service • This license is non-exclusive, worldwide, and royalty-free • The license terminates when you delete your content or account Restrictions: • You may not copy, modify, or distribute the Service • You may not reverse engineer or attempt to extract source code • You may not use our trademarks without written permission

Service Availability: • The Service is provided "as is" and "as available" • We do not guarantee uninterrupted or error-free service • We may modify or discontinue features at any time Professional Advice: • The Service does not provide medical or psychological advice • AI-generated insights are tools, not professional recommendations • Always consult qualified professionals for clinical decisions • We are not responsible for educational or clinical outcomes No Warranties: • We disclaim all warranties, express or implied • This includes warranties of merchantability and fitness • We do not warrant that the Service will meet all your requirements

To the maximum extent permitted by law: • We are not liable for any indirect, incidental, or consequential damages • Our total liability is limited to the amount you paid in the past 12 months • This limitation applies regardless of the legal theory • Some jurisdictions do not allow these limitations You agree to indemnify and hold us harmless from any claims arising from: • Your use of the Service • Your violation of these Terms • Your violation of any third-party rights • Your content or data

Account Termination: • You may terminate your account at any time through account settings • We may terminate or suspend your account for Terms violations • We may terminate for extended inactivity (12+ months) • Termination does not relieve you of payment obligations Effect of Termination: • Your right to use the Service ceases immediately • We may delete your data after 90 days • Educational institutions may request data export before deletion • Certain provisions of these Terms survive termination

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through: 1. Good faith negotiations 2. Mediation (if negotiations fail) 3. Binding arbitration in Dallas, Texas Class action lawsuits and class arbitrations are not permitted.

We may update these Terms from time to time. When we make changes: • We will update the "Last Updated" date • We will notify you via email or in-app notification • Continued use after changes constitutes acceptance • Material changes require explicit consent for educational accounts You should review these Terms periodically for changes.
